On July 26, 2018, Michael Paul served as a moderator for a panel of construction attorneys and clients at the ALFA International Construction Practice Group Seminar in Banff, Alberta, Canada. The panel titled “Right to Repair Statutes: A Fix to Construction Defect Litigation?” explored the many different right to repair laws throughout the United States, all of which were passed in an effort to curb construction defect litigation. The panel discussed what aspects of certain laws have been successful and what aspects have fallen short of their stated goals. They also covered how contractors, subcontractors, and others in the construction industry can take advantage of the opportunities afforded by these statutes. Insurance considerations, particularly a carrier’s obligation to defend an insured during these presuit periods, were also discussed.
