In a major development impacting employers and employees alike, a United States District Court issued an Order November 22, 2016 granting a preliminary injunction enjoining the United States Department of Labor from implementing its new overtime rules, which were set to go into effect on December 1, 2016. Among other things, the new rule would have raised the salary level required to invoke certain “white collar” exemptions to the requirement for overtime pay under the Fair Labor Standards Act (FLSA). The preliminary injunction applies on a nationwide basis, therefore barring the Department of Labor from enforcing the new overtime requirements in any other jurisdiction as well.
On December 1, 2016, the Obama administration filed a Notice of Appeal with the district court, stating its intent to appeal the granting of the preliminary injunction to the Fifth Circuit.
