The Winter issue of CLM’s Construction Claims magazine features an article co-authored by Joseph E. Cavasinni. Mr. Cavasinni’s article, “From Passive to Proactive: Avoiding Costly Delays in High-Exposure Design and Construction Claims,” discusses the advantages of early investigation and evaluation of high exposure claims, especially in circumstances where the insured has a high SIR, eroding or finite aggregate limits; there is a project default and subcontractor default or contractor protective indemnity coverage applies; or an excess carrier is monitoring a claim being defended by the primary carrier’s counsel of choice.
The article dives into effective early investigation strategies, using ADR as a cost-control tool, and timing and coordination considerations in design-build projects that define claim outcomes. They also discuss coordinated defense efforts on policies with deductibles/SIRs, eroding limits, and of finite aggregate limits.
