Defense Verdict for Hall & Evans’ Client in Premises Liability Case

Gina M. Rossi and Shannon M. Hurley received a complete defense verdict on behalf of a bar in a Denver District Court case after a four-day jury trial.  The plaintiff slipped on a wet floor and fractured her wrist. The plaintiff had two surgeries, medical expenses of approximately $113,000, and claimed a whole person impairment rating of 10%. Despite an adverse inference instruction against the defendant for failing to retain surveillance video of the incident, the jury found that the defendant used reasonable care to protect against a danger on the premises, and that no failure of the defendant caused the plaintiff’s injuries and damages.
