Douglas J. Kotarek was quoted in Business Insurance’s December 17 article titled, “Provider choice proposals trending in comp.” The article discusses states that are moving to expand injured workers’ abilities to choose their own doctors in workers’ compensation cases, including Colorado, Indiana, and Washington.
Mr. Kotarek speaks to the potential effects posed by giving the injured worker the choice of physician in Colorado after HB 25-1300 passed earlier this year. The bill takes away from the employer and/or insurer the right of giving a list of four doctors to choose from to the injured worker and gives the choice of physician to the injured worker. The bill takes effect January 1, 2028.
